Municipal Solid Waste (MSW) Landfill: timeline

Compliance Dates

Existing Sources: January 16, 2004
New Sources: January 16, 2003 or upon startup
Area Sources that Change into Major Source: January 16, 2004 or upon startup

What is an Affected Source?

The MSW landfill is a major HAP source or is located with a major source.

The MSW landfill is an area source with a design capacity of 2.5 million megagrams and 2.5 million cubic meters (m3); and has uncontrolled emissions equal to or greater than 50 megagrams per year of nonmethane organic compounds.

The MSW landfill must have accepted waste after November 8, 1987 or has additional capacity to accept waste.

MSW Landfills with Bioreactors that meet these requirements:

New source

  • Must install gas collection and control system before starting to add liquids and began operating the system 180 days after initiating liquids or after achieving 40% moisture content.
Existing source
  • Install collection system by January 17, 2006 or the date required   by 40 CFR 60 Subpart WWW.
  • If the liquid addition does not begin until after January 17,2006 then the source must install gas collection and control system before starting to add liquids and began operating the system 180 days after initiating liquids or after achieving 40% moisture content.
